OFFICIAL RULES
LEGAL TERMS APPLICABLE GLOBALLY TO THIS CONTEST
NO PURCHASE NECESSARY. A PURCHASE DOES NOT IMPROVE YOUR CHANCE OF
WINNING.
1) PROMOTION DESCRIPTION: The Beauty Envision Awards People’s Choice Award Contest
(the “Contest”) begins September 20, 2024 at 12:00PM (noon) Pacific Time (“PT”) and ends
on September 25, 2024 at 11:59PM PT (the “Voting Period”). By participating in the
Contest, you unconditionally accept and agree to comply with and abide by these Official
Rules and the decisions of the Wella Company and judges, which shall be final and binding
on all matters relating to the Contest.
2) SPONSOR: Wella Operations US LLC and Wella Beauty Canada ULC (“Wella,” “Wella
Company,” or “Sponsor”), 4500 Park Granada, Calabasas, CA 91302 USA.
3) ELIGIBILITY: The Contest is only open to the ten (10) Hair category winners (“Entrants”)
from The Beauty Envision Awards Competition (the “Competition”) that concluded on July
14, 2024. Voting to select the Contest winner is restricted to individual legal residents of the
50 United States and D.C., 18 years of age or older (“Voters”).
4) PUBLIC VOTING TO DETERMINE THE WINNER IN THIS CONTEST: During the Voting
Period, Sponsor will post the ten (10) winning entries (each an “Entry”) from the
Competition at www.beautyenvisionawards.com (the “Website”) for public voting. Eligible
Voters can visit the Website and follow the on-screen instructions to vote for their favorite
Entry. Posted Entries represent solely the opinions of Entrant, not those of the Sponsor.
Limit one (1) vote per person/email address per Entry per day. A person may only use one
(1) email address to vote. Votes received from any person or email address in excess of the
stated limitation will be void. Any attempt by a Voter or other individual/entity to manipulate
or undermine the integrity of the voting as determined by Sponsor/Administrator in its sole
discretion may result in disqualification of the Entrant and/or votes, with the understanding
that disqualification shall not represent the sole remedy available to Sponsor.
Entrants/Voters are prohibited from obtaining votes by any fraudulent or inappropriate
means, including, without limitation, spamming, offering prizes or other inducements, as
determined by Sponsor in its sole discretion. The use of script, macro, or any other robotic
or automatic devices for voting and any other means that subvert the voting process is
prohibited, and Sponsor reserves the right to nullify all such votes and to block the
responsible individual from voting. Vote tabulation data will not be disclosed to Entrants,
Voters or the public. By being included as an Entrant in this Contest, Entrants agree to be
bound by and not challenge the final decisions of Sponsor and the individual judges for this
Contest. In the event that a winning Entry is discovered to be invalid for any reason
whatsoever or the Entrant fails to comply with these Official Rules prior to delivery of the
prize, the prize may be forfeited and may be awarded to an alternate winner.
5) WINNER DETERMINATION: At the conclusion of the Voting Period, the Entrant that
received the most eligible votes (once vote verification is complete) will be deemed the
potential Grand Prize winner, subject to verification of eligibility and compliance with all
terms and conditions set forth in these Official Rules. In the event of a tie, the Sponsor will
judge the tied Entries based on overall creativity (100%) to determine the winner. Decisions
of the Sponsor are final with respect to all matters relating to the Contest.
6) PRIZE AND APPROXIMATE RETAIL VALUE: (1) Grand Prize - An 8-day/7-night trip for
winner only from May 25, 2025 through June 1, 2025 to Paris, France. Trip includes round-
trip economy class air transportation to Paris, car rental for length of stay, hotel
accommodations (based on single occupancy), a 7-day all-inclusive cultural and creative
retreat at AHA Paris including Museums, Wella Studio tour, a full day of Hair Education,
cooking class, sightseeing and a Sponsor-determined high Fashion Editorial photoshoot
(collectively, “Activities”) (ARV $6,500.)
Sponsor reserves the right to substitute a prize of equal or greater value if advertised prize
(or portion of prize) is unavailable for any reason. No substitution or transfer of prize by
winner is permitted, other than as described above. Income taxes related to the Grand Prize
is the sole responsibility of the winner. Trip must be taken on dates specified by Sponsor,
which are subject to change. Sponsor will determine airline and flight itinerary in its sole
discretion. Airline carrier's regulations and conditions apply. No refund or compensation will
be made in the event of the cancellation or delay of any flight. Travel and accommodations
are subject to availability. Travel is subject to the terms and conditions set forth in this
Contest, and those set forth by the Sponsor’s airline carrier of choice as detailed in the
passenger ticket contract. Winner agrees to follow any applicable COVID protocols that
may be in place at time of travel. Trip may not be combined with any other offer and travel
may not qualify for frequent flyer miles. The winner must possess a U.S. passport valid for
at least six (6) months after travel is completed, ETIAS travel authorization, VISA, etc.; visit
www.tsa.gov for a list of TSA-approved IDs. Travel restrictions, conditions and limitations
may apply. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or
certificates. Actual value may vary based on airfare fluctuations and distance between
departure and destination. All other expenses and costs, not expressly listed above,
including, but not limited to, taxes, insurance, telephone charges, room service and laundry
services, personal expenses, gratuities, entertainment, transfers, incidental charges, or any
other items not specifically described in these Official Rules, any transportation not
mentioned within such prize descriptions and all expenses for any of the foregoing are the
sole responsibility of the winner. Sponsor and/or any other relevant party, reserve the right
to remove or to deny entry to the winner, if they engage in a disruptive manner, or with intent
to annoy, abuse, threaten, or harass any other person during the Activities. All details of the
Activities are in Sponsor’s sole discretion. Resale of prize is prohibited. Unused tickets
cannot be refunded, exchanged for cash. No responsibility is assumed by the Sponsor if
any Events are cancelled, rescheduled, delayed or postponed in whole or in part.
7) GENERAL PRIZE CONDITIONS/WINNER NOTIFICATION: The potential winner will be
sent, via email link, a Declaration of Eligibility, Liability & Publicity Release (where legal) and
assignment of rights (“Declaration”) and will be required to complete, and sign and return
the Declaration via email within 5 days of being notified in order to claim the prize. If the
potential winner fails to return the Declaration within the required time period, or the prize
notification is returned undeliverable, or in the event that the potential winner is disqualified
for any reason or ineligible, Sponsor will award the applicable prize to an alternate winner
based on the eligible votes received as outlined above. If prize notification is returned as
undeliverable, and/or if potential winner is not in compliance with the Official Rules (including
eligibility requirements), then potential winner will be disqualified and an alternate potential
winner will be determined. Winner is subject to verification by Sponsor, whose decisions are
final and binding in all matters related to the Contest.
8) GENERAL LIABILITY RELEASE/FORCE MAJEURE: Entrants/Voters agree that the
Sponsor, its subsidiaries, parent, divisions, promotional partners, agencies, affiliates,
advertising, and promotion agencies (collectively “Promotion Entities”) shall not be
responsible or liable for, and are hereby released from, any and all costs, injuries, losses or
damages of any kind, due in whole or in part, directly or indirectly, to participation in the
Contest or any Contest/voting-related activity, or from Entrants’ acceptance, receipt,
possession and/or use or misuse of prize or Voters participation in the voting. Promotion
Entities have not made any warranty, representation or guarantee express or implied, in fact
or in law, with respect to any prize, including, without limitation, to such prize’s quality or
fitness for a particular purpose. The Promotion Entities assumes no responsibility for any
damage to an Entrants’/Voters’, or any other person’s, computer system which is
occasioned by accessing the Website or any website or otherwise participating in the
Contest, or for any computer system, phone line, hardware, software or program
malfunctions, or other errors, failures, delayed computer transmissions or network
connections that are human or technical in nature. Without limiting the generality of the
foregoing, the Promotion Entities are not responsible for incomplete, misdirected,
misprinted, late, lost, damaged, stolen prize notifications; or for lost, interrupted,
inaccessible or unavailable networks, servers, satellites, Internet service providers,
websites, or other connections; or for miscommunications, failed, jumbled, scrambled,
delayed, or misdirected computer, telephone or cable transmissions; or for any technical
malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or
inaccurate capture of information, or the failure to capture any information. Sponsor
reserves the right in its sole discretion to disqualify any individual who is found to be
tampering with the voting process or the operation of the Contest, to be acting in violation of
these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the
intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse,
threaten or harass any other person, and Sponsor reserves the right to seek damages and
other remedies from any such person to the fullest extent permitted by law. Sponsor
reserves the right to modify, extend, suspend, or terminate the Contest if it determines, in its
sole discretion, that the Contest is technically impaired or corrupted or that fraud or technical
problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed
or severely undermined or to any degree impaired the integrity, administration, security,
proper play and/or feasibility of the Contest as contemplated herein. In the event the
Sponsor is prevented from awarding the prize or continuing with the Contest as
contemplated herein by any event beyond its control, including but not limited to fire, flood,
natural or man-made epidemic or pandemic of health of other means, earthquake,
explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure,
riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any
federal, state, provincial, territorial or local government law, order, or regulation, public
health crisis, order of any court or jurisdiction, or other similar or dissimilar cause not
reasonably within Sponsor’s control (each a "Force Majeure" event or occurrence), then
subject to any governmental or regulatory approval which may be required, Sponsor shall
have the right to modify, suspend, extend or terminate the Contest. In the event the Contest
is compromised by virus, bug, unauthorized human intervention, or other causes beyond the
control of Sponsor that corrupts or impairs the administration, security, fairness, or proper
administration of the Contest or voting, Sponsor reserves the right in its sole discretion to
suspend or terminate the voting and determine the potential winner from among all eligible
votes received prior to cancellation (and if voting is cancelled, Sponsor will determine a fair
way to judge all Entries to determine the winner.) No more than the stated prize described
in these Official Rules will be awarded. The invalidity or unenforceability of any provision of
these Official Rules shall not affect the validity or enforceability of any other provision. In the
event that any provision is determined to be invalid or otherwise unenforceable or illegal,
these Official Rules shall otherwise remain in effect and shall be construed in accordance
with their terms as if the invalid or illegal provision were not contained herein. CAUTION:
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE
CONTENT OR LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF
CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR
WILL DISQUALIFY ANY SUCH ENTRANT AND RESERVE THE RIGHT TO SEEK
DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY
SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
9) WINNER LIST: To request the name of the winner, send your request along with a self-
addressed stamped envelope, to Sponsor at the following address, within thirty (30) days
following the end of the Contest: The BEA People’s Choice Award Contest Winner, Wella
Company, 4500 Park Granada, Calabasas, CA 91302, USA.
10) PRIVACY NOTICE: Except as otherwise contemplated in these Official Rules, and to the
extent Entrants/Voters may otherwise elect, personal information collected in connection
with the Contest will be used in accordance with Sponsor’s online privacy policy, located at
https://www.wellacompany.com/en-us/privacy-policy. Any communication or information
transmitted to Sponsor by e-mail or otherwise is and will be treated as non-confidential and
non-proprietary.
